What is RTI and When it was enacted ?
Right to Information (RTI) is an act of the Parliament of India to provide for setting out the practical regime of the right to information for citizens to secure access to information under the control of public authorities, and to promote transparency and accountability in the working of any public authority. The basic object of the Right to Information Act is to empower the citizens,promote transparency and accountability in the working of the Government,contain corruption, and make our democracy work for the people in real sense.It goes without saying that an informed citizen is better equipped to keep necessary vigil on the instruments of governance and make the government more accountable to the governed.The Act is a big step towards making the citizens informed about the activities of the Government.

Process Of First And Second Appeals Under RTI

As per Right To Information Act, 2005 it is mandatory on the part of Public Information Officer (PIO) either to provide the information or reject the request within 30 days. However, information concerning life and liberty must be provided within 48 hours.

First Appeal Guideline

If an RTI is filed with the public authority (PIO/APIO), it is possible that the required answers are not obtained on the first time, and in some cases, information is not received at all. In such cases, First appeal is to be filed to receive the required information to the satisfaction of the citizen . As per the RTI Act, an appeal shall be disposed off within 30 days on the receipt of the appeal by the First Appellate Authority or within such extended period not exceeding a total of 45 days from the date of filing thereof, as the case may be, for reasons to be recorded in writing.

Second Appeal Guideline

Anybody who is unhappy or dissatisfied with the decision of the First Appellate Authority can file Second Appeal to the Information Commission. As per the RTI Act, an appeal shall be disposed off within 30 days on the receipt of the appeal by the First Appellate Authority or within such extended period not exceeding a total of 45 days from the date of filing thereof, as the case may be, for reasons to be recorded in writing. An appeal to the Central/ State Information Commission is required to be filed as per Section 19 (3) of the RTI Act against the decision of First Appellate Authority and, therefore, can be filed only after the decision of FAA or after stipulated time limit(45 days) for such decision by FAA has elapsed, as per provisions under Section 19(3) of the RTI Act. The Act, however, does not prescribe time limit or target for disposal of 2nd appeal/complaint.

Process Of First And Second Appeals

First Appeal Guideline
If required answers are not obtained, a First appeal is to be filed. It shall be disposed off within 30 days (max 45 days) of receipt.
Second Appeal Guideline
Dissatisfied users can file a Second Appeal to the Information Commission under Section 19(3). It can be filed only after the FAA decision or after 45 days.
